Wie sehr sich der buchstäbliche Sinn der Souveränität seit den Tagen Bodins und Hobbes' verdunkelt haben mag, die Figur der Souveränität hört nicht auf, auch moderne, 'dezentrierte' Gesellschaften, die die souveräne Macht dem Gesetz der Gewaltenteilung unterwerfen, heimzusuchen. Souveränität verweigert sich nicht nur hartnäckig der Historisierung, sondern zugleich auch der Alternative von moralischer Affirmation oder Verwerfung. Souveräne sind nicht bloß ausgezeichnete öffentliche Amts- und Würdenträger oder diejenigen, die sie mit souveräner Macht investieren. Die souveräne Funktion ist in einem gewissen Vermögen verankert, in der Fähigkeit, das Gesetz zu geben oder es im Ausnahmefall zu suspendieren. Souveräne Macht kann aber auch im Widerspruch und in der Manifestation gegen eine bestimmte institutionalisierte Herrschaftsordnung zum Ausdruck kommen, in der Beanspruchung einer Gleichheit durch diejenigen, die ungleich sind oder denen ein gleicher Anteil an der politischen Ordnung verweigert wird. Die Untersuchungen spannen einen Bogen, der von den klassischen Texten der antiken politischen Philosophie über die frühneuzeitlichen Souveränitätslehren bis hin zur politischen Ontologie Martin Heideggers reicht. Da die rechtsetzende Gewalt mit den Techniken der vorgängigen Figuralisierung oder Sichtbarmachung eines Raumes sowie mit der Entwicklung komplexer expressiver Codes, Wissensformen und Subjektivierungstechniken verbunden ist, wird die Lektüre der philosophischen Texte durch die Analyse solcher literarischen Werke (Sophokles, Shakespeare, Montaigne, Racine, Kafka) ergänzt, in denen die Probleme und Aporien, die Widersprüche und Störungen der politischen Verkörperung auf eine zugespitztere Weise verhandelt werden als in der politischen Theorie.

The State of Sovereignty examines how it came to pass that the nation-state became the prevailing form of governance in the world today. Spanning the 19th and 20th centuries and addressing colonization and decolonization around the globe, these essays argue that sovereignty is a set of historically contingent practices, and not something that accrues naturally to states. The contributors explore the different ways in which sovereign political forms have been defined and have defined themselves, placing recent debates about nations and national identity within a broader history of sovereignty, territory, and legality.
